Sinai Marble & Stone – Terms of Service

1. General Information

Sinai Marble and Stone ("Company," "we," "our," "us") specializes in providing high-quality natural stone pavers, tiles, coping, pool decking, and related materials.

Natural stone is a product of nature. Variations in color, texture, veining, shade, calibration, size, and surface characteristics are inherent and are not considered defects. Customers acknowledge and accept these natural variations.

2. Acceptance of Terms

By accessing or using our website or purchasing products from Sinai Marble & Stone, you acknowledge that you have read, understood, and agree to these Terms of Service.

If you do not agree to these Terms, please refrain from using our website or purchasing our products.

3. Products and Availability

All products are subject to availability.

We reserve the right to discontinue or modify products without prior notice.

Natural stone products are typically sold by the crate or pallet, and minimum order requirements may apply.

4. Pricing and Payments

All prices are listed in U.S. Dollars and are subject to change without notice.

Unless otherwise agreed to in writing, full payment is required before shipment.

We accept major credit cards, ACH transfers, checks, and wire transfers.

Credit card payments are subject to a 3% processing fee.

5. Shipping, Delivery & Risk of Loss

Shipping charges are calculated based on the destination, shipment weight, and selected delivery method.

Delivery dates are estimates only and are not guaranteed.

Sinai Marble & Stone is not responsible for shipping delays caused by freight carriers, weather conditions, labor disputes, equipment failures, acts of God, governmental actions, or other circumstances beyond our reasonable control.

Risk of Loss

Unless otherwise agreed to in writing, all shipments are made FOB Origin (Shipping Point). Title to and risk of loss transfer to the purchaser immediately upon delivery of the shipment to the freight carrier.

Sinai Marble & Stone is not responsible for loss, breakage, shortages, or damage occurring after the shipment has been accepted by the carrier.

6. Inspection, Breakage & Claims

Customers are responsible for inspecting all shipments immediately upon delivery.

Any visible shortages, breakage, or damage must be:

  • Noted on the carrier's delivery receipt before signing.

  • Photographed before unloading whenever possible.

  • Reported to Sinai Marble & Stone on the same day delivery is completed.

Failure to follow these procedures may affect the ability to process claims.

Because natural stone products are shipped in bulk and handled multiple times during transportation, up to 10% breakage per pallet is considered an acceptable industry tolerance and should be accounted for when ordering material. Claims for credit, replacement, or refund within this tolerance will not be accepted.

Claims submitted after the day of delivery may not be honored.

7. Freight Damage Claims

Freight damage occurring after the shipment leaves our facility is the responsibility of the freight carrier.

Sinai Marble & Stone will reasonably assist customers by providing invoices, photographs, shipping documentation, and other information necessary to support freight damage claims.

Such assistance does not constitute an acceptance of liability for freight damage.

8. Authorized Returns, Refunds & Replacement Material

All sales are final unless otherwise authorized in writing by Sinai Marble & Stone.

Requests for returns or refunds are considered solely at the discretion of Sinai Marble & Stone. Authorization to return material does not guarantee a refund.

Authorized Returns or Refunds must meet all of the following conditions:

  • Prior written authorization from Sinai Marble & Stone is required.

  • Material must be in its original, unopened packaging and in resalable condition.

  • If the material has been delivered, it must be returned within fourteen (14) days of the delivery date.

  • A 35% restocking fee applies to all approved returns, regardless of whether the material has been picked up, shipped, delivered, or remains at a Sinai Marble & Stone facility awaiting shipment.

The restocking fee compensates for inventory reservation, warehouse storage, administrative processing, material handling, and lost sales opportunities while the material was held for the customer's order.

Discounted, clearance, closeout, custom, special-order, or discontinued materials are final sale and are not eligible for return, refund, or credit.

Replacement material provided as a courtesy or goodwill accommodation does not constitute an admission of liability.

Unless otherwise agreed to in writing, freight charges associated with replacement shipments remain the responsibility of the purchaser.

9. Limitation of Liability

Sinai Marble & Stone shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the purchase, delivery, installation, or use of its products.

This includes, but is not limited to:

  • Installation or removal costs

  • Labor expenses

  • Contractor delays

  • Project downtime

  • Lost profits

  • Loss of business opportunities

  • Additional transportation costs

Our maximum liability shall never exceed the original purchase price of the affected material.

10. Collection Costs

Any unpaid balances are subject to collection.

If legal action becomes necessary to collect amounts owed, Sinai Marble & Stone reserves the right to recover all costs of collection, including reasonable attorney's fees, court costs, service fees, collection agency fees, and interest at the maximum rate permitted by applicable law.

11. Intellectual Property

All website content, including text, photographs, logos, graphics, product descriptions, and other materials, is the property of Sinai Marble & Stone and is protected under applicable copyright and trademark laws.

Unauthorized use is prohibited.

12. Governing Law

These Terms shall be governed by the laws of the State of Florida.

Any legal action arising from these Terms or any purchase from Sinai Marble & Stone shall be brought exclusively in the state or federal courts located in Broward County, Florida.

13. Changes to These Terms

Sinai Marble & Stone reserves the right to modify these Terms at any time without prior notice.

Updated Terms become effective immediately upon posting to our website.
